- Primero. REVOCAR el fallo proferido por el Juzgado 23 Civil del Circuito de Bogotá, dentro del proceso de la referencia.
- Segundo. TUTELAR los derechos a la vida en conexidad con el derecho a la salud del señor Héctor José Guerrero Obando. En consecuencia, se ordena al Instituto de los Seguros Sociales, que en el término de 48 horas contadas a partir del momento de la notificación del presente fallo, si aún no lo ha hecho, garantice la práctica de la CIRUGÍA DE EXTRACCIÓN DE CATARATA MAS RESECCION PTERIGIO OJO DERECHO.
- Tercero. Para garantizar la efectividad de la acción de tutela, el Juzgado Veintitrés Civil del Circuito de Bogotá, notificará esta sentencia dentro del término de cinco días después de haber recibido la comunicación, de conformidad con el artículo 36 del Decreto 2591 de 1991.
- Cuarto. Líbrese por Secretaría General la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
