Demanda de inconstitucionalidad contra los artículos 26, 27, 37 y 38 de la ley 44 de 1993, por la cual se modifica y adiciona la Ley 23 de 1982 y se modifica la Ley 29 de 1944.
El demandante solicitó declarar inexequible las expresiones acusadas, por desconocer los artículos 150 numeral 8 y 333 de la Constitución Política.
La Corte reiteró que las facultades de inspección, vigilancia y control por parte de la Dirección Nacional de Derecho de Autor son una expresión de la intervención del Estado en la economía y por ello decidió declarar EXEQUIBLES los apartes demandados contenidos en los artículos 26, 27, 37 y 38 de la Ley 44 de 1993.
