Demanda de inconstitucionalidad contra la Ley 1098 de 2006, por la cual se expide el Código de la Infancia y la Adolescencia.
El actor adujo que la precitada norma es inconstitucional por quebrantar el artículo 152 Superior.
En su criterio, fue tramitada y expedida por el Congreso de la República como ley ordinaria, sin considerar que era una materia de ley estatutaria.
El incumplimiento de los requisitos de especificidad y suficiencia no le permitió a la Corte abordar un examen de fondo y decidir sobre la validez de la disposición acusada.
Con base en lo anterior, decidió declararse INHIBIDA para emitir pronunciamiento, por la ineptitud sustantiva de la demanda.
