Demanda de inconstitucionalidad contra el parágrafo 1º del artículo 155 de la Ley 1801 de 2016, por la cual se expide el Código Nacional de Policía y Convivencia.
La demandante aduce que la norma cuestionada vulnera los artículos 24 y 28 de la Constitución Política, porque le otorga facultades excesivas a los agentes de policía para que ordenen el traslado de protección de una persona que está involucrada en una riña o que ha desplegado un trato agresivo o temerario.
Tras verificar la configuración del fenómeno de la cosa juzgada constitucional formal, en virtud de la expedición de providencia previa que declaró la inexequibilidad de la misma norma ahora cuestionada, la Sala Plena de la Corporación decidió ESTARSE A LO RESUELTO en la Sentencia C-281/17.
