- PRIMERO. REVOCAR la sentencia del cinco (5) de mayo de dos mil cuatro (2004) adoptada por el Juzgado Veintisiete Civil del Circuito de Bogotá, mediante la cual se denegó la acción de tutela de la referencia. En su lugar, TUTELAR los derechos fundamentales a la salud, a la seguridad social y a la igualdad del menor Nicolás Santiago Rodríguez Andrade.
- SEGUNDO. ORDENAR al Director General de Sanidad Militar que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a adoptar todas las medidas necesarias para que el menor Nicolás Santiago Rodríguez Andrade sea afiliado al Subsistema de Salud de las Fuerzas Militares en tanto beneficiario de la señora Luz Margarita Andrade de Rodríguez, durante el término necesario para que las entidades competentes determinen cuál habrá de ser el régimen permanente dentro del cuál se protegerá de manera efectiva el derecho del menor a acceder a los servicios de salud.
- TERCERO. Por Secretaria General, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
