Primero. REVOCAR el fallo proferido por el Tribunal Superior del Distrito Judicial de Santa fe de Bogota. En consecuencia, conceder la tutela al derecho a la vida, salud y seguridad social del senor JOSE RICARDO BERNAL ROBAYO.
Segundo. ORDENAR a la Caja Agraria o a la entidad que haga sus veces, que en el termino de veinticuatro (24) horas a partir de la notificacion de esta sentencia, realice un nuevo estudio de la solicitud de sustitucion pensional, para el cual no podra aplicar los criterios discriminatorios contenidos en sus anteriores respuestas y que han propiciado equivocadamente, la denegacion de la peticion de sustitucion pensional.
Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del decreto 2591 de 1991.
