La accionante considera que sus derechos fueron vulnerados porque el Ministerio de Protección Social revocó irregularmente su pensión de jubilación que recibía desde el año 1995, aduciendo que dicha resolución fue expedida de manera ilegal.
La Sala encuentra que en el presente caso la accionante incurrió en temeridad al instaurar la presente acción de tutela, ya que presentó dos tutelas con identidad de partes, identidad de causa, e identidad de objeto.
Declara improcedente.

- Primero. REVOCAR las sentencias proferidas por el Tribunal Administrativo de Cundinamarca - Sección Segunda Subsección A -, el catorce (14) de noviembre de dos mil (2008); y por el Consejo de Estado - Sección Cuarta, el cuatro (4) de marzo de dos mil nueve (2009); y en su lugar, DECLARAR IMPROCEDENTE, por las razones expuestas en la parte motiva de esta providencia, la tutela promovida por Ruby Judith Bovea Torres.
- Segundo. LIBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los fines allí establecidos.
