- PRIMERO. Confirmar la decisión que denegó la tutela de la referencia, ADICIONADA en los siguientes aspectos:
- a) Se condena en "costas" a Alexander Tovar González, por haber incurrido en temeridad al instaurar la presente tutela, liquidación que hará el Juzgado de tutela de primera instancia teniendo como único factor para valorar la TEMERIDAD, la ponderación entre los límites que establece el artículo 73 del C. de P.C. (diez a veinte salarios mínimos mensuales). Cifra que una vez tasada y cuando haya quedado en firme se consignará a nombre del Consejo Seccional de la Judicatura en Ibagué en la oficina y cuenta respectiva.
- b) Se ordena remitir copia de esta sentencia al Consejo Seccional de la Judicatura en Ibagué en relación con las costas indicadas en el literal anterior.
- c) Se remitirá copia de esta providencia al Procurador Regional, con jurisdicción en Ataco, para lo que estime pertinente.
- SEGUNDO. Comuníquese lo resuelto en esta providencia al Juzgado Unico Penal Municipal de Ataco para las notificaciones y efectos previstos en el artículo 36 del Decreto 2591 de 1991.
- TERCERO. Envíese copia de este fallo al Defensor del Pueblo para lo que estime pertinente.
