Igualdad, educación.
La accionante actúa como representante de su menor hijo y solicita se ordene a la institución educativa accionada autorizar la matrícula para su hijo en el año lectivo 2009, ya que fue sancionado debido a su mal comportamiento y bajo rendimiento académico, la madre aporta pruebas respecto a la depresión sufrida por su hijo y el tratamiento psiquiátrico que esta siguiendo en donde se le recomienda no desescolarizarlo ya que esto entorpecería la terapéutica médica y el proyecto de vida del niño.
La Sala solicitó a la madre del menor que informara al despacho sobre la situación actual del menor, ante lo cual la señora manifestó que su hijo se encuentra estudiando en otra institución educativa y que sigue con el tratamiento psiquiátrico, por lo tanto se encuentra frente a un hecho superado por carencia actual de objeto.
