- PRIMERO. REVOCAR el fallo del once (11) de febrero de dos mil cuatro, proferido por el Juzgado Treinta Civil del Circuito de Bogotá, y en su lugar TUTELAR el derecho de petición solicitado por la señora ROSA ELVIRA ARIAS GOMEZ.
- SEGUNDO. ORDENAR a la Caja Nacional de Previsión Social (CAJANAL), seccional Bogotá, que si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia profiera el acto administrativo correspondiente que resuelva de fondo lo solicitado por la señora ROSA ELVIRA ARIAS GOMEZ.
- TERCERO. PREVENIR a la Caja Nacional de Previsión Social (CAJANAL) para que en el futuro se abstenga de incurrir en esta clase de actuaciones que, como en el caso concreto, vulnera los derechos fundamentales de sus afiliados.
- CUARTO. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
