- Primero. REVOCAR las sentencia proferida por la Sala de Casación Laboral de la Corte Suprema de Justicia, que negó la protección del derecho reclamado por el señor Gonzalo de Jesús Restrepo. En su lugar, TUTELAR el derecho de petición.
- Segundo. ORDENAR a Cajanal, que si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia proceda a pronunciarse de fondo sobre el objeto de la petición elevada por el señor Gonzalo de Jesús Restrepo.
- Tercero. PREVENIR a Cajanal para que en el futuro se abstenga de incurrir en actuaciones que vulneran los derechos fundamentales de sus afiliados.
- Cuarto. Por Secretaría, líbrense la comunicación de que trata el artículo 36 del decreto 2591 de 1991
