- Primero. REVOCAR el fallo proferido por el Juzgado
- Segundo. Civil del Circuito de Bogotá del tres (3) de mayo de dos mil cuatro (2004) y en su lugar TUTELAR el derecho de petición de la señora Luz Aida Isaza Silva.
- Segundo. ORDENAR a la Caja Nacional de Previsión Social - CAJANAL, que si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, proceda a proferir un acto administrativo que resuelva de fondo la petición elevada por la señora Luz Aida Isaza Silva.
- Tercero. PREVENIR a la Caja Nacional de Previsión Social CAJANAL, para que en el futuro se abstenga de incurrir en esta clase de actuaciones que, como en el caso concreto, vulnera los derechos fundamentales de sus afiliados.
- Cuarto. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
