- Primero. REVOCAR la sentencia proferida por el Juzgado
- Quinto. Penal Municipal de Bogotá, que denegó la tutela solicitada, en la acción instaurada por la señora LUZ MARINA NARANJO DE HURTADO contra CAJA SALUD A.R.S.
- Segundo. En su lugar, CONCEDER la tutela de los derechos a la salud y a la seguridad social, en conexidad con la dignidad y la integridad personal de la solicitante.
- Tercero. ORDENAR a la ARS CAJA SALUD que en el término de quince (15) días, contados a partir de la notificación de esta sentencia, programe la cirugía que requiere la señora Luz Marina Naranjo de Hurtado.
- Cuarto. INDICAR a CAJA SALUD A.R.S. que podrá repetir contra el Fondo de Solidaridad y Garantía (FOSYGA) por todos los gastos en los que incurra en cumplimiento de lo ordenado en este fallo y que no esté cubierto por el P.O.S-S.
- Quinto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
