PRIMERO. REVOCAR por las razones expuestas en la parte motiva de esta providencia, la sentencia proferida por el Juzgado Trece Penal Municipal de Barranquilla el 22 de junio de 1995, y en su lugar TUTELAR los derechos a la salud por conexidad con los derechos a la vida y a la integridad fisica de la nina GISELLA PAOLA ECHAVARRIA RODRIGUEZ.
SEGUNDO. ORDENAR al INSTITUTO DE SEGUROS SOCIALES de Barranquilla que suministre en forma inmediata, a partir de la fecha de la notificacion del presente fallo, los medicamentos requeridos por la citada menor, incluido el denominado "DESMOPRESINA NASAL". Asi mismo esa entidad debera prestar la atencion medica necesaria para continuar con el tratamiento que estaba adelantando el INSTITUTO DE SEGUROS SOCIALES -SECCIONAL MEDELLIN-.
TERCERO. COMPULSAR copias de este proveido a la PROCURADURIA GENERAL DE LA NACION a fin de que inicie la investigacion a que haya lugar como consecuencia de la negativa del INSTITUTO DE SEGUROS SOCIALES -SECCIONAL ATLANTICO- con sede en la ciudad de Barranquilla a dar cumplimiento al fallo proferido por el Juzgado Vigesimo Penal Municipal de Medellin el 23 de agosto de 1994.
CUARTO. LIBRENSE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
