- Primero. REVOCAR las sentencias proferidas por el Juzgado
- Septimo. Civil del Circuito de Bogota D.C., del 20 de noviembre de 2001 y por el Tribunal Superior del Distrito Judicial de Bogota D.C. Sala Civil, del 21 de enero de 2002, dentro de la accion de tutela instaurada por Lina Harker de Morales contra Salud Colmena E.P.S. En su lugar TUTELAR los derechos fundamentales a la integridad personal de la accionante y a la salud en conexidad con la vida.
- Segundo. ORDENAR al representante legal de Salud Colmena Entidad Promotora de Salud realizar a la senora Lina Harker de Morales la cirugia bariatrica por Laparoscopia, dentro de los diez (10) dias siguientes a la notificacion de la presente sentencia, con cargo al contrato de medicina prepagada y conforme a las prescripciones del medico tratante.
- Tercero. PREVENIR en los terminos del articulo 24 del Decreto 2591 de 1991 a Salud Colmena Entidad Promotora de Salud a traves de su representante legal para que en lo sucesivo se abstenga de incurrir en las conductas que dieron origen a esta accion de tutela.
- Cuarto. Dar cumplimiento a lo previsto en el articulo 36 del Decreto 2591 de 1991.
