Primero. REVOCAR la sentencia proferida por el Juzgado Promiscuo Municipal de Hispania - Antioquia. En su lugar, TUTELAR los derechos fundamentales a la salud y la vida del menor BRAYAN FERNANDO CHICA RESTREPO.
Segundo. ORDENAR a la A.R.S. COOSALUD del Municipio de Hispania, (Antioquia) que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente decisión, proceda, si aún no lo ha hecho, a autorizar los exámenes médicos que fueren necesarios para determinar la posible cirugía que requiere el menor, sin que sea razón para la negativa de la prestación del servicio, la edad del niño, ni la exigencia del carné de afiliación a la A.R.S.
En el evento de que los tratamientos a realizar impliquen costos a los que no esta obligada legalmente la A.R.S., ésta podrá hacer uso de la acción de repetición en contra del Estado, con cargo, al Fondo de Solidaridad y Garantía o a cargo de los recursos del subsidio a la oferta del régimen subsidiado (artículo 31 del decreto 806 de 1998).
Tercero. Por Secretaría General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
