- Primero. REVOCAR el fallo proferido por el Juzgado
- Décimo. Laboral del Circuito de Cali dentro de la acción de tutela instaurada por Eleazar Carabali contra el Instituto de Seguro Social -Seccional Cali-, y en su lugar CONCEDER el amparo de tutela por las razones expuestas en la parte motiva de esta providencia.
- Segundo. ORDÉNASE al Instituto de Seguro Social -Seccional Cali- que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta providencia, resuelva de fondo en forma clara y precisa la solicitud de reconocimiento de pensión formulada por el actor, si ya no lo hubiere hecho y notifique al actor de su decisión formal.
- Tercero. PREVENIR al Instituto de Seguro Social -Seccional Cali-, para que no vuelva a incurrir en una conducta omisiva como la que dio lugar a la formulación de la presente acción de tutela.
- Cuarto. Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
