- R E S U E L V E:
- PRIMERO. CONFIRMAR PARCIALMENTE la sentencia de 2 de diciembre de 1993, proferida por el Juez Promiscuo de Güicán, en cuanto tuteló el derecho a la liquidación de cesantía de Marcos Rincón Carreño y revocarla parcialmente en cuanto ordenó la cancelación de una suma de dinero, todo lo anterior de acuerdo a los considerandos de este fallo.
- SEGUNDO. El peticionario Marcos Rincón Carreño no está obligado a devolver la suma de dinero que recibió, según se explicó en la parte motiva de esta Sentencia.
- TERCERO. Prevenir al Alcalde y al Concejo de Güicán para que en lo sucesivo incluyan en el Presupuesto Municipal cantidades suficientes para pagar oportunamente las prestaciones sociales de sus empleados y trabajadores.
- CUARTO. Ordenar que por Secretaría se comunique esta providencia al Juzgado Promiscuo Municipal, al Alcalde y al Concejo de Güicán, al Defensor del Pueblo y a Marcos Rincón Carreño.
