- PRIMERO. REVOCAR la sentencia proferida del Juzgado
- Octavo. Penal del Circuito de Bogotá, de fecha 24 de octubre de 2001, mediante la cual no se concedió la acción de tutela del señor Ulises Estupiñan Leon.
- SEGUNDO. CONCEDER la tutela a la señor Ulises Estupiñan Leon, por las razones expuestas en la parte motiva de este fallo. En consecuencia, se ORDENA al Presidente de Acerías Paz del Río S.A. o a quien haga sus veces que, dentro del plazo de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, se paguen las mesadas pensiónales hasta la fecha y que han dado lugar a la presente tutela. En caso de que ello no se haya efectuado, deberá realizar las gestiones pertinentes a fin de garantizar el pago de las mesadas adeudadas. Dichas gestiones no podrán exceder el término perentorio de tres (3) meses.
- TERCERO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
