Se atribuye a Colpensiones la vulneración de derechos fundamentales, como consecuencia de revocar la pensión de invalidez de la accionante sin su consentimiento, argumentando que el dictamen médico que fundamentó el reconocimiento de la prestación era fraudulento.
Teniendo en cuenta que en sede de revisión se constató que la pensión objeto de discusión no se encuentra activa porque fue sustituida por una pensión vitalicia de vejez, la Corte decidió declarar la carencia actual de objeto por la ocurrencia de un HECHO SOBREVINIENTE.

- PRIMERO. REVOCAR la sentencia dictada en segunda instancia por la Sala de decisión Civil-Familia-Laboral del Tribunal Superior del Distrito Judicial de Riohacha el 13 de agosto de 2020, mediante la cual se confirmó parcialmente la decisión del Juzgado Promiscuo del Circuito de San Juan del Cesar, Guajira, del 5 de marzo de 2020, a través de la cual se concedió transitoriamente el amparo solicitado.
- En su lugar, DECLARAR la carencia actual de objeto por existencia de un hecho sobreviniente, de conformidad con los motivos expuestos en la parte motiva de esta sentencia.
- SEGUNDO. Por la Secretaría General, LÍBRESE la comunicación a que se refiere el artículo 36 del Decreto 2591 de 1991.
