- Primero. REVOCAR la sentencia proferida el 26 de septiembre de 2001, por el Juzgado
- Octavo. Laboral del Circuito de Cali. En su lugar, TUTELAR el derecho fundamental de petición al señor Gildardo Alzate Piedrahita.
- Segundo. ORDENAR a la empresa Industrias Kent y Sorrento S.A., que el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente decisión, proceda a dar respuesta a la petición del actor, teniendo en cuenta para ello, lo establecido por el artículo 57 del Código Sustantivo del Trabajo (C.S.T), de conformidad con las consideraciones aquí expuestas.
- Tercero. Por Secretaría General, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
