- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E:
- PRIMERO. CONFIRMAR la sentencia de junio 11 de 2004 proferida por el Juzgado Veintitres Penal del Circuito de Bogota, mediante la cual a su vez confirmo integramente el fallo del 4 de mayo de 2004 proferido por el Juzgado Catorce Penal Municipal de Bogota mediante el cual se denego la tutela impetrada por el senor Fernando Cote Pena contra la Universidad Externado de Colombia.
- SEGUNDO. REVOCAR la sentencia de junio 4 de 2004 proferida por el Juzgado Dieciseis Penal del Circuito de Bogota y en su lugar confirmar la sentencia de 12 de abril de 2004 proferida por el Juzgado Setenta y Tres Penal Municipal de Bogota, mediante la cual se denego la tutela impetrada por la senora Alexandra Fruto Nieto contra la Universidad Externado de Colombia.
- TERCERO. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1.991.
