- Primero. Por las razones expuestas en la parte motiva de esta providencia, REVOCAR el fallo del Tribunal Superior del Distrito Judicial de Neiva, Sala Penal, mediante el cual se negó el amparo de tutela invocado y en su lugar CONFIRMAR la decisión proferida por el Juzgado Penal del Circuito de La Plata Huila, en el sentido de TUTELAR los derechos a la seguridad social, debido proceso, defensa y la familia, de los menores YIRA y LENIN FABIAN OSSA PADILLA, representados por su madre MARIA CECILIA PADILLA CAMPO.
- Segundo. ORDENAR al Fondo Nacional de Prestaciones Sociales del Magisterio, dé cumplimiento a lo resuelto en esta sentencia, dentro del término de cuarenta y ocho horas (48) contadas a partir de la notificación del fallo.
- Tercero. LIBRAR, por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
