- Primero. REVÓCASE, la sentencia del catorce (14) de julio de 2003 proferida por el Juzgado
- Quinto. Civil Municipal de Barranquilla, en la acción de tutela instaurada por el señor Javier Antonio Sierra Navarro, en contra de la EPS Salud Colmena. En su lugar, CONCÉDASE el amparo solicitado.
- Segundo. ORDÉNASE al representante legal de la EPS Salud Colmena o a quien haga sus veces que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, autorice el procedimiento médico quirúrgico prescrito al demandante, así como los medicamentos y tratamientos que se llegaren a necesitar como consecuencia de este procedimiento, a fin de que no se afecte la vida del actor.
- Tercero. A la Empresa Promotora de Salud demandada, le asiste el derecho de repetir por lo que pague en cumplimiento de este fallo de tutela ante el Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (Fosyga).
- Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
