Derecho a la unidad familiar y de los niños por la omisión del inpec de no ordenar el traslado de interno condenado por homicidio de la penitenciaria de máxima seguridad de valledupar a la carcel de itagui en donde pueda ser visitado por su familia.
Solicita se ordene el traslado del interno.
Legitimación por activa de la abuela del menor.
En el presente caso el padre del menor ha instaurado dos tutelas por los mismos hechos que ahora se mencionan.
Unidad familiar y privación de la libertad.
Las causales de traslado se encuentran taxativamente consagradas en la ley.
La negativa del inpec de trasladar al interno no se debe al capricho del ente demandado sino a que el interno no reune los requisitos para concederle su solicitud.
Los derechos del menor no estan siendo afectados con la medida legitima de condena para su padre en un centro de reclusión lejos del sitio donde vive el menor.

- Segundo. Por Secretaria General, LIBRENSE las comunicaciones a que se refiere el articulo 36 del decreto 2591 de 1991.
