R E S U E L V E
PRIMERO. REVOCAR la sentencia de mayo 13 de 1993, proferida por la Sala Plena del Tribunal Superior de Riohacha.
SEGUNDO. DENEGAR la acción de tutela interpuesta por el Personero Municipal de Riohacha por las razones expuestas en esta providencia.
TERCERO. ORDENAR que por Secretaría General se remita copia de la presente providencia con destino al Procurador General de la Nación con el fin de que se investigue disciplinariamente a los funcionarios de la Alcaldía Municipal de Riohacha en relación con la situación denunciada por su Personero Municipal.
CUARTO. LIBRESE comunicación al Juzgado Unico Laboral del Circuito de Riohacha, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
