- Primero. REVOCAR la sentencia proferida por el Juzgado
- Tercero. Penal Municipal de Santa Marta, el día 27 de noviembre de 1995.
- Segundo. CONCEDER la tutela reclamada por la Señora Raquel Estupiñán Henríquez en nombre de sus hijos menores FABIAN ANDRES y JUAN FELIPE. En consecuencia ordenar al Departamento Administrativo de Seguridad -DAS-, que suspenda transitoriamente, y por el término de treinta (30) días hábiles contados a partir de la notificación personal de esta providencia a la peticionaria, la ejecución de la Resolución 230 del diez (10) de agosto de 1995 de la Dirección Seccional del Departamento Administrativo de Seguridad -DAS-; durante dicho término de treinta dias se permitirá el reingreso legal al Señor Robert Müller, para que resuelva sin dilaciones y sin sanciones, su legal estancia y permanencia en el territorio de la República y atienda sus deberes familiares.
- La mencionada suspensión tendrá efectos mientras se defina la mencionada situación de permanencia del citado ciudadano alemán.
- Tercero. Líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
