- Primero. REVOCAR la sentencia proferida por la Sala Laboral del Distrito Superior del Distrito Judicial de Pereira el dieciocho (18) de septiembre de 2002 en el que se negó la acción interpuesta por el accionante.
- Segundo. CONCEDER la tutela de la referencia para proteger el derecho a la salud en conexidad con el derecho a la vida del actor. En consecuencia, ORDENAR al INPEC que, en el término de cinco (5) días contados a partir de la notificación de la presente sentencia, asegure a Jorge Humberto Montoya Borrero el tratamiento y los medicamentos que requiere para atender la afección renal de la que padece, de acuerdo con el procedimiento establecido en el INPEC para el efecto.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
