- PRIMERO. REVOCAR la providencia del Tribunal Superior de Neiva -Sala de Familia- en el proceso de acción de tutela promovido por Jaime Alfredo Peláez Guzmán y Gonzalo Perdomo Cabrera en contra del Colegio Cooperativo Salesiano San Medardo de la ciudad de Neiva.
- SEGUNDO. En aplicación del artículo 24 del decreto 2591, esta Corte previene a las directivas del Colegio Cooperativo Salesiano San Medardo para que en ningún caso vuelvan a incurrir en las acciones que dieron mérito para que se concediera la tutela.
- TERCERO. En todos aquellos casos similares al presente por sus hechos o circunstancias, siempre que se vulnere el derecho al libre desarrollo de la personalidad en la aplicación de reglamentos educativos, la doctrina constitucional enunciada en esta sentencia tendrá CARACTER OBLIGLATORIO para las autoridades, en los términos del artículo 23 del decreto 2067 de 1991.
- CUARTO. Ordenar que por Secretaría se comunique esta providencia al Tribunal Superior de Neiva y al Colegio Cooperativo Salesiano San Medardo de Neiva, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
