- R E S U E L V E:
- PRIMERO. REVOCAR la sentencia proferida el 6 de Marzo de 1992 por el Juzgado 36 Penal de Medellín en el proceso de tutela promovido por Gisela González Marín contra Alberto Galeano, rector del IDEM José María Bravo Márquez de dicha ciudad.
- SEGUNDO. Por las razones expuestas en la parte motiva de esta providencia ORDENAR al Rector de dicho plantel que readmita inmediatamente a la alumna OLGA CRISTINA MUÑOZ GONZALEZ para que continúe sus estudios de bachillerato.
- TERCERO. En todos aquellos casos similares al presente por sus hechos o circunstancias, siempre que el contenido, interpretación y aplicación del reglamento de una institución educativa vulnere derechos constitucionales fundamentales de sus alumnos, la doctrina constitucional enunciada en esta sentencia tendrá CARACTER OBLIGATORIO para las autoridades, en los términos del artículo 23 del decreto 2067 de 1991.
- CUARTO. ORDENAR que por Secretaría se comunique esta providencia al Juzgado 36 Penal Municipal de la ciudad de Medellín, en la forma y para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
