- Primero. REVOCAR por las razones expuestas en la parte motiva de esta sentencia el fallo proferido el 10 de Agosto de 2001 por el Tribunal Administrativo de Santander, por medio de la cual se negó el amparo al derecho a la seguridad social, a la igualdad, a la vida y a la salud del Señor Timoleón Villamizar Pavón. Por consiguiente OTORGAR el amparo en relación con sus derechos fundamentales de protección especial a las personas de la tercera edad, mínimo vital y seguridad social.
- Segundo. ORDENAR al Fondo de Pensiones Territorial de Santander, emitir y pagar la cuota parte del bono pensional que le corresponde, en el evento en que el Instituto de Seguro Social reconozca la pensión del Señor Timoleón Villamizar Pavón, dentro del término de quince (15) días, contados a partir del reconocimiento de la pensión de jubilación.
- Tercero. Por Secretaria General, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
