- Primero. REVOCAR la sentencia proferida por el Juzgado Veintiuno Penal Municipal de Bogotá. En consecuencia conceder la tutela al derecho a la vida y seguridad social del señor Gilberto Espinosa Gómez.
- Segundo. ORDENAR al ISS, que si aún el Ministerio de Hacienda no ha remitido el respectivo bono pensional, requiera nuevamente a dicha entidad, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente tutela.
- Tercero. ADVERTIR al ISS que una vez el Ministerio de Hacienda remita el bono pensional Tipo B que corresponde al señor Gilberto Espinosa Gómez, continúe con los trámites necesarios para el reconocimiento de la pensión al demandante.
- Cuarto. LÍBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del decreto 2591 , para los efectos allí previstos.
