- PRIMERO. CONFIRMAR la sentencia de la Sala Penal del Tribunal Superior del Distrito Judicial de Valledupar, pronunciada el 16 de junio de 1995, que tutelo el derecho a la defensa al senor Luis Roberto Troncoso Maestre, con la MODIFICACION del ordinal 2o. en el sentido de decretar la nulidad del proceso penal, a partir del auto que declaro persona ausente al citado.
- SEGUNDO. Por Secretaria COMUNICAR la presente decision a la Sala Penal del Tribunal Superior de Valledupar para los efectos contemplados en el articulo 36 del Decreto 2591.
