- Primero. Declarar EXEQUIBLE la expresión "el manejo, administración y ejecución de estos recursos se hará exclusivamente en la forma dispuesta en la Ley que los crea y se destinarán solo al objeto previsto en ella", del artículo 29 del Estatuto Orgánico del Presupuesto (Decreto 111 de 1996), siempre y cuando se entienda que esta norma hace referencia no sólo a la ley que crea la contribución parafiscal sino también a aquellas normas legales posteriores que la hayan modificado.
- Segundo. Declarar EXEQUIBLES los dos primeros incisos acusados del artículo 16 de la Ley 344 de 1996, "por la cual se dictan normas tendientes a la racionalización del gasto público, se conceden unas facultades extraordinarias y se expiden otras disposiciones".
