Demanda de inconstitucionalidad contra el parágrafo 3 del artículo 850 del Decreto 624 de 1989, Estatuto Tributario, adicionado por el artículo 267 de la Ley 1819 de 2016.
El actor considera que la norma acusada vulnera los principios de igualdad, de equidad y de progresividad tributaria establecidos en los artículos 13 y 363 de la Constitución Política.
La ausencia de certeza, especificidad y suficiencia del cargo de vulneración de la igualdad, no permitió a la Corte contar con los elementos de juicio para realizar un examen de fondo y proferir un fallo de mérito.
