- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E:
- Declarar la EXEQUIBILIDAD de la parte demandada del articulo 62 de la Ley 443 de 1998 bajo el entendido de que la expresion "la indemnizacion a que tendria derecho", a la que se refiere la primera parte del tercer inciso del mencionado articulo, incorpora (1) la compensacion por la totalidad de los salarios dejados de percibir en el interregno entre el retiro y la fecha del parto y, (2) el pago mensual, a la correspondiente entidad promotora de salud, de la parte de la cotizacion al Sistema General de Seguridad Social en Salud que corresponde a la entidad publica en los terminos de la ley, durante toda la etapa de gestacion y los tres meses posteriores al parto.
