Demanda de inconstitucionalidad contra el artículo 97 de la Ley 2294 de 2023, por el cual se expide el Plan Nacional de Desarrollo 2022-2026, Colombia Potencia Mundial de la Vida.

La demandante adujo que la norma acusada es contraria a los artículos 158 y 333 de la Constitución Política, los cuales se refieren, respectivamente, al principio de unidad de materia y a la libre competencia económica.

Luego de confirmar la existencia de una cosa juzgada formal y absoluta y la supresión de la disposición demandada del ordenamiento jurídico, en virtud de la declaratoria de su inexequibilidad, la Sala Plena de la Corporación decidió ESTARSE A LO RESUELTO en la Sentencia C-537/23.
