Se denegó la solicitud formulada por el accionante para que se declare la nulidad de la Sentencia T-443/00, para la Sala Plena el tratamiento dado al citado fallo se ajustó a los lineamientos señalados por la Corte, con base en ellos se revocó aplicando las orientaciones indicadas por la Corte en relación con la configuración de la vía de hecho, no encontrando motivo o razón de nulidad tampoco por esta razón ni por la modificación en el cambio de jurisprudencia.
