- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Segundo. de Penas y Medidas de Seguridad de Barranquilla el 30 de diciembre de 2003. En consecuencia, CONCEDER la acción de tutela para proteger el derecho fundamental de petición del señor Édinson Pérez Bermúdez.
- SEGUNDO. ORDENAR al Instituto de Seguros Sociales, Seccional Atlántico, que si aun no lo hecho, dentro de los cinco (5) días hábiles siguientes a la notificación de esta providencia profiera el acto administrativo correspondiente que resuelva de fondo lo solicitado por el señor Édinson Pérez Bermúdez.
- TERCERO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
