  1. Primero. REVOCAR las sentencias dictadas por el Juzgado
  2. Quinto. Civil del Circuito de Palmira y por el Juzgado
  3. Tercero. Civil del Circuito de Guadalajara de Buga, Valle del Cauca, ambas el 24 de mayo de 2002, dentro de los expedientes radicados en la Corte Constitucional bajo los Nos. 615797 y 616588, respectivamente, en virtud de la demandas de tutela promovidas por las señoras ZORAIDA CASTRO y MARIELA HURTADO DE FATAT.
  4. Segundo. CONCEDER, por las razones expuestas en la presente sentencia, la tutela del derecho fundamental de petición a las accionantes ZORAIDA CASTRO y MARIELA HURTADO FATAT, vulnerado por el Instituto de Seguro Social, Seccional Valle del Cauca.
  5. Tercero. ORDENAR al Gerente del Instituto de Seguro Social, Seccional Valle del Cauca, que por la instancia y/o funcionario competente, dentro de las cuarenta y ocho (48) horas siguientes a la notificación personal del presente fallo, se resuelvan de fondo los recurso de Reposición y Apelación interpuestos por la señora ZORAIDA CASTRO contra la Resolución No. 004809 de 1999, y el recurso de Reposición presentado por la ciudadana MARIELA HURTADO FATAT contra la Resolución No. 008224 de 2001, mediante las cuales, en su orden, se negó la pensión de sobreviviente a la primera, y se reconoció indemnización sustitutiva a la segunda.
  6. Cuarto. ORDENAR que por la Secretaría General de la Corte, se compulsen copias de los dos expedientes, y se remitan a la Procuraduría Regional del Valle del Cauca, para los fines indicados en la parte motiva de esta providencia.
  7. Quinto. ORDENAR que por la Secretaría, se libren las comunicación previstas en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
