- Primero. REVOCAR los fallos proferidos por los juzgados 49 Penal Municipal de Bogotá, D.C., y 55 Penal del Circuito de la misma ciudad que negaron la tutela incoada por Alvaro Cruz Corredor y, en su lugar, CONCEDER el amparo deprecado.
- Segundo. ORDENAR a Compensar E.P.S. que, en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia, autorice y lleve a cabo al actor el tratamiento odontológico ordenado por el médico tratante y le preste la atención integral necesaria.
- Así mismo, se declara que le asiste derecho a la E.P.S. Compensar de repetir contra el FOSYGA por lo que pague en cumplimiento de lo establecido en la presente sentencia.
- Tercero. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
