- PRIMERO. REVOCAR la sentencia proferida el 23 de abril de 2004 por el Juzgado
- Quinto. Civil Municipal de Barranquilla. En CONSECUENCIA, se tutela el derecho a la vida en condiciones dignas en conexión con el derecho a la salud del señor Rubén Darío Rodríguez Viloria.
- SEGUNDO. ORDENAR a la A.R.S. HUMANA VIVIR S.A. de Barranquilla que, en las cuarenta y ocho horas (48) siguientes a la notificación de esta sentencia, le autorice al señor Rubén Darío Rodríguez Viloria la cirugía de Artroscopia que le fue ordenada por su médico tratante Dr. Carlos García.
- TERCERO. Señalar que la A.R.S. HUMANA VIVIR S.A. de Barranquilla podrá repetir en contra del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud, FOSYGA, por el costo que se requiera para la cirugía de Artroscopia y el tratamiento a seguir, en cumplimiento de esta sentencia.
- CUARTO. INAPLICAR con base en el artículo 4º de la Constitución Política y para el caso concreto del señor Rubén Darío Rodríguez Viloria, la norma reglamentaria del Plan Obligatorio de Salud Subsidiado que excluye el tratamiento ordenado, a saber, el artículo 17 de la Resolución 5261 de 1994.
- QUINTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
