Derecho al acceso a la administracion de justicia y a la informacíon de hija de afiliada fallecida que desea conocer las causas de la muerte a quien la entidad se niega a suministrarle copia de la historia clinica de la madre aduciendo reserva legal de la informacion.

Que la reserva de la historia clinica no desaparezca por el fallecimiento del paciente no es un criterio absoluto.

- Primero. REVOCAR la sentencia proferida el 17 de abril de 2006 por el Juzgado
- Cuarto. Civil Municipal de Barranquilla, que nego la accion de tutela instaurada por la senora Iveth Patricia Perez Ramos, en contra de la IPS Punto de Salud Boston de Barranquilla. En su lugar, se dispone TUTELAR sus derechos de acceso a la administracion de justicia y a la informacion.
- Segundo. ORDENAR a la IPS Punto de Salud Boston de Barranquilla, que en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, si no lo hubieren hecho, expida una copia completa de la historia clinica de la senora Aminta Ramos Valenzuela y se la entregue exclusivamente a su hija Iveth Patricia Perez Ramos.
- Tercero. Por Secretaria General, LIBRENSE las comunicaciones a que se refiere el articulo 36 del Decreto 2591 de 1991.
