La accionante solicita el, pago y reajuste de la pensión de sobreviviente en un 75% de lo de lo devengado por un congresista en ejercicio, considera haber adquirido el derecho debido al fallecimiento de su esposo quien fue ex – congresista.
La Sala pasa a estudiar, la procedencia excepcional de la acción de tutela contra actos administrativos en materia pensional, se concluye que el mínimo vital de la accionante no se encuentra afectado y por lo tanto no se demostró la ocurrencia de un perjuicio cierto, inminente y grave que amerite declarar un amparo transitorio.
