- Primero. REANUDAR los términos dentro del proceso de tutela de la referencia (expediente T-884089), los cuales fueron suspendidos por orden de esta Sala Quinta de Revisión, mediante Auto del 7 de Julio de 2004.
- Segundo. REVOCAR las sentencias de noviembre veinticuatro de 2003 proferida por el Juzgado Doce Civil Municipal de Cartagena y de enero tres de 2004, proferida por el Juzgado
- Sexto. Civil del Circuito de Cartagena por las razones expuestas en la parte motiva de esta providencia. En consecuencia CONCEDER la tutela de los derechos fundamentales a la vida y a la salud de la señora Victoria Soleno de Castaño.
- Tercero. ORDENAR a Coomeva E.P.S. que, dentro del término perentorio de cuarenta y ocho (48) horas contadas a partir de la notificación de esta sentencia, autorice y haga entrega del medicamento FOSAMAX a la señora Victoria Soleno de Castaño en la cantidad y por el tiempo que lo considere necesario su médico tratante.
- Cuarto. SEÑALAR que Coomeva E.P.S., podrá repetir contra el FOSYGA lo que desembolse en cumplimiento del presente fallo. El FOSYGA dispondrá de quince (15) días para reconocer lo debido o indicar la fecha máxima dentro de la cual lo hará y luego, dará cumplimiento a la obligación reconocida.
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
