Primero. REVOCAR las decisiones proferidas por el Juzgado
Primero. Laboral del Circuito de Cúcuta de julio 18 de 1996 y por la Sala Laboral del Tribunal Superior de Cúcuta del 23 de agosto del mismo año.
Segundo. CONCEDER la tutela impetrada. En consecuencia, se ordena al Gobernador del Departamento de Norte de Santander que, si todavía no lo ha hecho, proceda dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia a cancelar a los docentes del departamento, aquí demandantes y cuyos nombres y números de cédula aparecen en la solicitud de tutela, los salarios que les adeuda, correspondientes al año de 1996, siempre que haya partida presupuestal disponible. En caso contrario, dentro del mismo término, iniciará los trámites pertinentes, de todo lo cual informará, inmediatamente, al juez de primera instancia.
Tercero. LÍBRENSE por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
