- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. CONFIRMAR el fallo de fecha 9 de noviembre de 1994, proferido por la Sala de Casación Civil de la Corte Suprema de Justicia, mediante el cual se confirma el fallo de fecha 12 de octubre de 1994, proferido por la Sala de Decisión Civil del Tribunal Superior del Distrito Judicial de Pasto, que no concedió la tutela solicitada por Jorge Enrique Quiñones Hernández, pero por las razones expuestas en esta providencia.
- SEGUNDO. ORDENAR que por la Secretaría General de esta Corporación se comunique el contenido de esta providencia a la Sala Penal del Tribunal Superior del Distrito Judicial de Pasto, en la forma y para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
