- Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Pasto el 16 de julio de 1996 y, en su lugar, CONFIRMAR PARCIALMENTE, la proferida por el Juzgado promiscuo de Familia de Mocoa, el 29 de mayo de 1996.
- Segundo. CONCEDER la tutela impetrada. En consecuencia, se ordena al Gobernador del Departamento del Putumayo que, si todavía no lo ha hecho, proceda, dentro de las 48 horas siguientes a la notificación de esta sentencia, a cancelar a los miembros del Sindicato Unión de Trabajadores del Putumayo los salarios atrasados, correspondientes al año de 1996, con su respectivo reajuste, siempre que haya partida presupuestal disponible. En caso contrario, dentro del mismo término, iniciará los trámites pertinentes, de todo lo cual informará, inmediatamente, al juez de primera instancia.
- Tercero. LIBRENSE, por Secretaría, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
