- PRIMERO. Revocar la sentencia de fecha 6 de julio de 1994, proferida por la Sala De Casación Penal de la H. Corte Suprema de Justicia, que a su vez confirmó la sentencia del Tribunal Superior -Sala Penal- del Distrito Judicial de Santafé de Bogotá, de mayo 24 del año en curso, mediante las cuales se negó la tutela solicitada por el doctor Germán Sarmiento Palacio.
- SEGUNDO. Conceder a la peticionaria la tutela de los derechos fundamentales al debido proceso y al derecho de acceso a la justicia. Por lo tanto, la Fiscalía Delegada No. 257 deberá, a efectos de garantizar la tutela de dichos derechos, proceder a admitir la demanda de constitución de parte civil y a darle el trámite que según la ley procesal penal corresponde.
- TERCERO. Líbrense por intermedio de la Secretaría de la Corte las comunicaciones a que se refiere el artículo 36 del Decreto 2591 de 1991, para los fines allí previstos.
