PRIMERO. Revocar la sentencia adoptada por la Honorable Corte Suprema de Justicia, Sala de Casación Penal, el 5 de mayo de 1994 y, en su lugar, tutelar los derechos al debido proceso, al trabajo y al buen nombre del señor Manuel Iván Hidalgo Gómez, como mecanismo transitorio para evitar un daño irreparable.
La protección otorgada por medio de esta providencia se extenderá a los cuatro (4) meses siguientes a su notificación, si la acción correspondiente aún no ha caducado, y cesará al cumplirse tal término, si el señor Hidalgo Gómez no interpone, durante él, las acciones correspondientes ante la Jurisdicción Contencioso-Administrativa.
SEGUNDO. Ordenar al Honorable Tribunal Superior del Distrito Judicial de Manizales, abstenerse de dar aplicación a la Resolución No. 090 del 7 de diciembre de 1993, adoptada por la Procuraduría Provincial de Manizales, durante el término y con la condición señalada en el numeral anterior.
TERCERO. Remitir copia de la presente providencia a la Procuraduría General de la Nación, por las razones expuestas en la parte motiva, y para los fines que allí se indican.
CUARTO. Comunicar la presente providencia al Tribunal Superior del Distrito Judicial de Manizales, para los fines del artículo 36 del Decreto 2591 de 1991.
